清廷憲政改革的設(shè)想與實(shí)踐——以《大清新法令》為據(jù)_6896.pdf

1、中文摘要在以往的學(xué)術(shù)研究中，清廷憲政改革在很長(zhǎng)一段時(shí)間內(nèi)都被定性為一場(chǎng)旨在維持封建專制統(tǒng)治秩序的“騙局”。然而，學(xué)術(shù)界所存在的這種“騙局論“既不符合理論邏輯，也不符合歷史事實(shí)，是一種片面的學(xué)說(shuō)。事實(shí)上，清廷在憲政改革過(guò)程中一直把“實(shí)現(xiàn)憲政“作為其真實(shí)的改革目標(biāo)，并且對(duì)憲政改革的各方面內(nèi)容都進(jìn)行了系統(tǒng)的規(guī)劃與全面的實(shí)踐。雖然，清廷憲政改革最終因清王朝的滅亡而以失敗告終，但其初步取得成果卻為中國(guó)憲政的繼續(xù)發(fā)展提供了寶貴的資源。就當(dāng)下而言，清

2、廷憲政改革中所累積下來(lái)的經(jīng)驗(yàn)和教訓(xùn)仍對(duì)中國(guó)憲政建設(shè)具有極大的借鑒意義。本文以清廷憲政改革的規(guī)劃設(shè)計(jì)及實(shí)踐為主要論述內(nèi)容。文章共分五章，每一章的內(nèi)容分別如下：第一章以“憲政的概念及清廷對(duì)憲政的理解與表達(dá)”為論述主題。本章第一節(jié)介紹了筆者在總結(jié)學(xué)界對(duì)憲政概念所進(jìn)行的研究的基礎(chǔ)上而提出的自己關(guān)于憲政概念的幾點(diǎn)看法，以作為本文相關(guān)理論研究的概念起點(diǎn)。本章第二節(jié)介紹了清廷在憲政改革時(shí)對(duì)憲政概念的理解及表達(dá)。第二章以“清廷憲政改革的規(guī)劃與設(shè)計(jì)“為論

3、述主題。本章第一節(jié)介紹了清廷對(duì)其憲政改革所做出的情勢(shì)分析。本章第二節(jié)論述了清廷為憲政改革設(shè)置預(yù)備期的必然性與必要性。本章第三節(jié)介紹了清廷憲政改革過(guò)程中籌備憲政的步驟規(guī)劃。第三章以“清廷憲政改革的實(shí)施與考核’’為論述主題。本章第一節(jié)分析了清廷憲政改革的實(shí)施機(jī)制。本章第二節(jié)介紹了清廷為推行憲政改革所創(chuàng)制的一套憲政辦理機(jī)構(gòu)。本章第三節(jié)論述了有關(guān)清廷憲政改革考核的相關(guān)問(wèn)題。第四章以“清廷憲政改革的主要內(nèi)容及相關(guān)成果“為論述主題。本章第一節(jié)介紹了
