1、數位資源取得與著作授權,益思科技法律事務所賴文智律師@2006 電子資訊資源與學術聯盟研討會,數位館藏—授權vs.購買,傳統(tǒng)館藏具有實體物，以購買所有權的方式取得著作權法未賦予著作人「出借權」，圖書館等可自由出借予公眾數位館藏可能有實體光碟，亦可能為網路資源以取得使用授權的方式取得著作權法對著作人授權他人使用提供較佳的保護，被授權人須依授權契約規(guī)定利用數位館藏,著作權法有關授權規(guī)定,著作權法第37條規(guī)定：「Ⅰ著作財產權人

2、得授權他人利用著作，其授權利用之地域、時間、內容、利用方法或其他事項，依當事人之約定；其約定不明之部分，推定為未授權。Ⅱ前項授權不因著作財產權人嗣後將其著作財產權讓與或再為授權而受影響。Ⅲ非專屬授權之被授權人非經著作財產權人同意，不得將其被授與之權利再授權第三人利用。Ⅳ專屬授權之被授權人在被授權範圍內，得以著作財產權人之地位行使權利，並得以自己名義為訴訟上之行為。著作財產權人在專屬授權範圍內，不得行使權利。Ⅴ第二項至前項規(guī)定，於

11、se, to circulate Licensor records on the distant sites and/or the electronic communication network of entities distinct from the Subscriber without Licensor’s express written authorization, or to grant access to the Lice

12、nsor portal to any individual not expressly authorized to such network by Licensor.,Restrictions,11.1 Except as specifically provided elsewhere in this agreement, Subscriber shall not knowingly permit anyone other than A

13、uthorized Users to use the Database. Other than as specifically permitted in this Agreement, Subscriber may not use the Database for commercial purposes, including but not limited to the sale of the Database or bulk rep

14、roduction or distribution of the Database in any form. 11.2 Subscriber shall in no way authorize the extraction by the public of any element whatsoever of the Database. The rights granted to Subscriber in this agreemen

15、t are strictly personal and solely for the own needs of the Subscriber and the Authorized Users. 11.3 The Subscriber or any Authorized User cannot at any time make the Database partly or totally available to the public,

17、fy any copyright or other notices included in the Database. 11.6 The Subscriber is not allowed to use the Database in order to create a new catalogue or database, to transfer the data to or in (an)other database(s) or t

18、o manipulate and/or use the Database in a way which could, directly or indirectly, compete with Licensor. 11.7 The Subscriber commits itself not to publish, distribute or sell, in whatever way, the data obtained by usin

19、g the Database, and more generally not to damage in any way the right of reproduction or other rights held by Licensor.,授權契約與合理使用,著作權人依據授權契約雖然可以限制被授權人有關著作的利用的形式，但並不能據此限制圖書館或使用者依著作權法所享有合理使用的空間違反授權契約規(guī)定，並不代表一定構成著作財產權的侵害，可能

20、只有違反合約的責任而已,相關合理使用規(guī)定,著作權法第48條：「供公眾使用之圖書館、博物館、歷史館、科學館、藝術館或其他文教機構，於下列情形之一，得就其收藏之著作重製之︰一 應閱覽人供個人研究之要求，重製已公開發(fā)表著作之一部分，或期刊或已公開發(fā)表之研討會論文集之單篇著作，每人以一份為限。二 基於保存資料之必要者。三 就絕版或難以購得之著作，應同性質機構之要求者。」,相關合理使用規(guī)定,著作權法第51條：「供個人或家庭為非營利之目

21、的，在合理範圍內，得利用圖書館及非供公眾使用之機器重製已公開發(fā)表之著作。」,相關合理使用規(guī)定,著作權法第53條：「Ⅰ已公開發(fā)表之著作，得為視覺障礙者、聽覺機能障礙者以點字、附加手語翻譯或文字重製之。Ⅱ以增進視覺障礙者、聽覺機能障礙者福利為目的，經依法立案之非營利機構或團體，得以錄音、電腦、口述影像、附加手語翻譯或其他方式利用已公開發(fā)表之著作，專供視覺障礙者、聽覺機能障礙者使用?！?相關合理使用規(guī)定,著作權法第59條：「Ⅰ合法電腦程式著

22、作重製物之所有人得因配合其所使用機器之需要，修改其程式，或因備用存檔之需要重製其程式。但限於該所有人自行使用。Ⅱ前項所有人因滅失以外之事由，喪失原重製物之所有權者，除經著作財產權人同意外，應將其修改或重製之程式銷燬之。」圖書館取得有實體光碟的資料庫或數位資源，應可依本條規(guī)定之精神，以備份之目的，重製該光碟。,相關合理使用規(guī)定,著作權法第59-1條：「在中華民國管轄區(qū)域內取得著作原件或其合法重製物所有權之人，得以移轉所有權之方式散布之

23、?！箞D書館取得有實體光碟的資料庫或數位資源，應可依本條規(guī)定，將該光碟另行出售或贈予給其他人。,防盜拷措施與資料庫,著作權法第80-2條：「Ⅰ著作權人所採取禁止或限制他人擅自進入著作之防盜拷措施，未經合法授權不得予以破解、破壞或以其他方法規(guī)避之。Ⅱ破解、破壞或規(guī)避防盜拷措施之設備、器材、零件、技術或資訊，未經合法授權不得製造、輸入、提供公眾使用或為公眾提供服務。Ⅲ前二項規(guī)定，於下列情形不適用之：一、為維護國家安全者。二、中央或地

24、方機關所為者。三、檔案保存機構、教育機構或供公眾使用之圖書館，為評估是否取得資料所為者。四、為保護未成年人者。五、為保護個人資料者。六、為電腦或網路進行安全測試者。七、為進行加密研究者。八、為進行還原工程者。九、其他經主管機關所定情形。Ⅳ前項各款之內容，由主管機關定之，並定期檢討?！?防盜拷措施與資料庫,著作權法第八十條之二第三項各款內容認定要點第七點本法第八十條之二第三項第三款所稱檔案保存機構、教育機構或供公眾使用之
